ART. 1 – DEFINITIONS
"F.lli Legnami Pacifici srl" with registered office in Via dei Vasari 20, Orvieto (TR) Italy, regularly registered at the Business Register of Terni with n. 01239680554 with Fiscal Code and TVA n. 01239680554.
"Website" means www.strutturelegno.com website, owned by "F.lli Legnami Pacifici srl" and dedicated to the sale of wooden structures and furniture for gardens.
"Client" means any person purchasing products on the website, accepting our Sales Terms and Conditions.
"Order" means the products sale form to be filled in by the Client and sent to F.lli Pacifici Legnami srl.
"Products" means any good on sale on the website, pursuant to these Sales Terms and Conditions.
"Customized products" means any product made on special request of the client and according to the details given by the client when filling in the order form.
"Price" means the total due by the Client for the Products bought on the website.
"Agreement" means the sale agreement for the Products on sale on the website pursuant to these Sales Terms and Conditions
"Parties" of the sale agreement for the Products on sale on the Website are F.lli Legnami Pacifici srl (The Seller) and the Client (The Purchaser).
ART. 2 – PRODUCTS SALE AND SALES AGREEMENT
Products are sold according to Sales Terms and Conditions published on our website at the moment of the Order placing by the Client and in any case only upon "confirmation of the Order" by F.lli Legnami Pacifici srl. The confirmation must contain all the general and special conditions applicable to the agreement and following "Order confirmation" by the Client as follows.
Once the Client Order is received by F.lli Legnami Pacifici srl, they will send the confirmation of receipt of the Order to the e-mail address provided by the client together with the ordered products summary, Prices, delivery costs, methods and conditions of payment, delivery address, general and special conditions agreed in the Contract.
The Client will then confirm his/her Order. The client is committed to verify the accuracy of data indicated by F.lli Legnami Pacifici srl in the Order Confirmation and to communicate any possible rectification.
The sale Agreement is considered reached and binding when the Client resends his/her "Order confirmation" to the e-mail address provided by F.lli Legnami Pacifici srl.
In any case, products will be sent only upon receipt of the payment. The full payment, made according to the methods and conditions of payment indicated in the Order confirmation sent by F.lli Legnami Pacifici srl, is relevant to the conclusion of the agreement. In case of mistaken data and lack of rectification by the client, all the additional costs will be charged to the client.
In case of non availability of products following the Order request made by the client, F.lli Legnami Pacifici srl will soon communicate the non availability to the Client at the e-mail address provided. The Client will have the right to cancel his order without any costs and will receive a reimbursement in case he has already paid or he will be given the possibility to choose to receive the available products and ask for a reimbursement for the non available products. In this latter case the partial delivery will be valid and client will not have the right to ask for a partial delivery reimbursement.
"Customized Products" sold on our website are made on special request of the client and according to the details provided by the client in the Order Form. As for these Products no right of withdrawal is granted unless in case of mistaken order processing.
The full Agreement between the parties is constituted by these Sales Terms and Conditions together with the Purchase Order sent by the Client, confirmation of the Order by F.lli Legnami Pacifici srl, further confirmation of the Order by the client and data provided by the client when registering to our website.
Any modification of the Agreement (as stated by the previous ARTICLE) following the conclusion of the Agreement, must be accepted in writing by both Parties.
ART. 3 – DELIVERY METHOD, TIME AND PRICE
Purchased Products will be delivered by express courier to the address provided by the client. Responsibility of products and risks of delivery passes from F.lli Legnami Pacifici srl to the Client when the Products are given to the express courier for delivery.
The Price of products as indicated on our website does not include shipping and delivery costs. These additional costs will be indicated by F.lli Legnami Pacifici srl in the order confirmation sent to the e-mail address of the client who will have the right to re-confirm or cancel the order without any costs. For International deliveries, the Client will be charged of possible customs duties and/or additional delivery costs.
Delivery times are as follows: 20 working days from the date of further confirmation of the Order by the Client; for customized products delivery, delivery time will be indicated by F.lli Legnami Pacifici srl at the moment of the order confirmation. Delivery time is in any case approximate and not binding. F.lli Legnami Pacifici srl will not be responsible for any delivery delay.
ART. 4 – PRICE AND METHODS OF PAYMENT
Prices of Products sold on our website are expressed in Euro (€) and inclusive of VAT.
The total due indicated in the Order confirmation sent by F.lli Legnami Pacifici srl includes the price of each product and shipping/delivery costs, as indicated in Art.3
The Price applied will be the price shown on our website at the moment of the Order placing by the client, shipping /delivery costs not included.
Methods of payment accepted according to the Order confirmation sent by F.lli Legnami Pacifici srl are the following:
ART. 5 – WEBSITE REGISTRATION AND CLIENT OBLIGATIONS
In order to purchase Products, the client must proceed to the online registration following the instructions provided on our website. He must provide his personal data in order for us to process his Order and deliver the Products. The registration is free of charge. The client must communicate accurate, true and complete data.
The client is responsible to keep a copy of the Order confirmation sent by F.lli Legnami Pacifici srl and copy of the Sales Terms and Conditions.
ART. 6 – DELAY IN THE PERFORMANCE FOR FORCE MAJEURE
The Parties are not responsible in case they are unable to carry out their obligations in accordance with the time schedule provided by the Agreement as a result of an event of force majeure or any other comparable cause beyond the reasonable control of the Party concerned. They will be given the possibility of a deadline extension in order to fulfil their obligations.
ART. 7 – RIGHT OF WITHDRAWAL
The Client has the right to cancel the Purchase Order without any costs and without stating any reason as follows:
The client will be reimbursed of the total paid and will be obliged to return all the items.
The right of withdrawal is granted only if not related to professional activities.
To cancel the Order the Client must send a letter sent by recorded delivery with acknowledgement of receipt to F.lli Pacifici Legnami srl Via dei Vasari 20 05018 Orvieto (TR) Italia within 10 working days from products delivery.
The letter can be anticipated within the same deadline by e-mail to the following address: info@strutturelegno.com or via fax to the number +39 0763 316567 or by telegram to F.lli Pacifici Legnami srl Via dei Vasari 20 05018 Orvieto (TR) Italia.
The communication of withdrawal must state the willing to cancel the Order and indicate which are the products you do not want to receive.
The Client must return the products complete and undamaged, with the whole related documentation and undamaged labels.
The client must return the products within 10 working days from the communication of withdrawal to the following address: F.lli Pacifici Legnami srl Via dei Vasari 20 05018 Orvieto (TR) Italia.
The client must ship the products well packed in order to avoid any possible damage. In any case the products are shipped at the client risk. The Client must bear all the costs of returning the items.
After receipt of the withdrawal communication, F.lli Pacifici Legnami srl will refund the Client of the total paid within 30 days and only if all the items have been returned undamaged.
As for Customized Products, no right of withdrawal is granted unless in case of mistaken order processing.
ART. 8 – WARRANTIES IN CASE OF DAMAGED PRODUCT
The client is granted of all the warranties in case of damaged product and according to current regulations.
ART. 9 – COMMUNICATION BETWEEN THE PARTIES
All the communications between the parties must be in writing and sent to the addresses provided by each party in the Agreement and in the Order. E-mail communications (at the addresses provided by each party in the Agreement and in the Order) are also considered written communications.
Communications relating to validity and existence of Contract must be sent by recorded mail with acknowledgement of receipt.
ART. 10 – TRADEMARKS, LOGOS AND PARTICULAR FEATURES
All the trademarks, logos and particular features are the exclusive property of the owners. Non authorized third parties are prohibited to use the trademarks, logos and particular features published on our website (reproduction of the said content on other websites is prohibited too).

ART. 11 – PRIVACY
Client data is processed according to D.Lgs. n.196 2003 Data Protection Policy.

The entire Agreement (as defined in art.2) is written both in Italian and English.
ART. 13 – APPLICABLE LAW AND JURISDICTION
Il Contratto sarà disciplinato e interpretato secondo le leggi italiane.
This Agreement will be disciplined by Italian Law. Over any disputes relating to the terms and conditions mentioned above shall have exclusive jurisdiction:
